Instant Hire — Trailer Hire Agreement
1. Agreement
By booking and collecting a trailer from Instant Hire, you agree to these terms in full. These terms form a binding hire agreement between you (the hirer) and Instant Hire (the owner).
2. Eligibility
You must hold a current, valid Australian driver's licence appropriate for the vehicle and load being towed. You must be 18 years of age or older. Your towing vehicle must be roadworthy and legally capable of towing the trailer's gross vehicle mass (GVM).
3. Hire period and charges
The hire fee is $100 per 24-hour period, charged at pickup. The hire period begins when the access code is issued and you collect the trailer keys. If you return the trailer late, an additional $100 charge per full 24-hour overstay period will be deducted from the security hold.
4. Security hold
A $200 security authorisation hold is placed on your card at pickup. This is not a charge — the funds are reserved, not taken. The hold is released after the trailer is returned and inspected. The owner reserves the right to capture funds from the hold for any of the following: damage to the trailer, late return fees, missing equipment, or towing/recovery costs incurred as a result of misuse.
5. Post-return inspection window
The owner reserves the right to charge against the security hold for up to 5 business days after the trailer is returned, if damage is identified after the post-return inspection. The hold will remain in place during this window and released as soon as the inspection is complete.
6. Your responsibilities
You are responsible for the trailer from the time you collect the keys until the time the system confirms return. You must not use the trailer for any illegal purpose. You must not allow any person other than yourself to operate the trailer without prior approval. You must report any accidents, damage, or theft immediately by calling 0400 835 580. You are responsible for any fines, tolls, or infringements incurred during the hire period.
7. Identity verification
Before the access code is issued, you are required to upload a photo of your driver's licence and complete a live selfie identity check. The resulting data is stored securely and linked to your hire record. By proceeding, you consent to this collection and storage for the purpose of identity verification and dispute resolution.
8. Pre- and post-hire videos
You are required to film a walk-around video of the trailer before and after the hire period. These videos are stored securely and used solely for the purpose of documenting the trailer's condition as a record for both parties.
9. Prohibited uses
The trailer must not be used to transport hazardous materials, overloaded beyond its rated GVM, towed by a vehicle incapable of safely towing it, or taken outside the state of New South Wales without prior written approval.
10. Theft and GPS tracking
Each trailer is fitted with a 4G GPS tracker with geofencing. If the trailer is moved outside its designated area without an active hire, or if theft is suspected, the owner may remotely activate the electric brake system and alert authorities. By proceeding with hire you acknowledge and consent to this.
11. Return procedure
To confirm return, you must: drive the trailer back to the correct location, lock the trailer and deposit the keys in the keypad safe, film a post-hire walk-around video and upload it through the website, and tap "Confirm Return" in the app. The hire is not officially closed until the system confirms the keys are in the safe and the safe door is locked. You remain liable until return is confirmed.
12. Cancellations
Bookings can be cancelled any time before the pickup step is initiated. No payment is taken at booking — there is nothing to refund. If you initiated the pickup process (paid and received the access code), you are liable for the full hire fee.
13. Liability
Instant Hire is not liable for any loss, damage, or injury arising from use of the trailer, except where required by Australian consumer law. You indemnify the owner against any third-party claims arising from your use of the trailer.
14. Governing law
These terms are governed by the laws of New South Wales, Australia.
